Mother convicted for refusing to examine and treat the child

A resident of the Tyumen region was found guilty of the death of her little daughter, whom she breastfed, despite the ban of doctors. The 34-year-old Tyumen woman had a positive HIV status. The baby was born in the summer of 2014, and immediately her mother went into open conflict with medical workers.

She categorically forbade examining her child, taking tests from him, and also officially refused antiretroviral therapy itself. The woman argued her actions by saying that "the acquired immunodeficiency virus does not exist, it was invented by pharmacists and this is a global conspiracy."

Last spring, the child died. A post-mortem examination carried out by Tyumen specialists showed that the child contracted HIV from the mother in early childhood or was born with this syndrome. Since no tests were performed during life, it is not possible to establish the exact time of infection.

But experts came to the conclusion that with timely detection of health problems, the child could have survived, since he would have been treated.

The spouse of the woman appealed to the law enforcement agencies with a statement and a request to hold her accountable for the fact that she consciously deprived their joint child of a chance for life. In the summer of 2017, the case was discontinued, as the spouses reconciled and, apparently, came to a common opinion on this tragic issue. However, the regional prosecutor's office was not satisfied with such an outcome and appealed against the closure of the criminal case.

The court took into account all the facts and came to the conclusion that the girl died because of the criminal actions of the mother. Woman January 31, 2018 read the verdict. According to Article 109 of the Criminal Code of the Russian Federation “Causing death through negligence,” she was sentenced to half a year of restriction of freedom.
