Divorce does not interfere with communication with children: the Family Code will be amended

The Government of Russia has prepared a draft law that significantly expands the circle of people who can freely communicate with children after the divorce of their parents. So far only the very close ones have this opportunity - parents, grandmothers and grandfathers. The bill allows communication with children for stepfathers, stepmother, former guardians and trustees.

Changes are planned to be made in two articles of the Family Code and in Article 5.35 of the Administrative Code.

To make such changes requires a decision of the European Court of Human Rights, which three years ago satisfied the claims of a Russian who could not see a child after a divorce, because he was a stepfather to a girl. At home, the courts refused him, because he was not officially considered the father.

However, the girl was raised by a man; she was very attached to him. After the divorce, the mother forbade her daughter to communicate with her former stepfather.

Experts of the Supreme Court of Russia also agreed with the decision of their European colleagues, but they proposed to oblige Russians provide evidence of their participation in the life of a non-native child.

Thus, after amendments to the codes, stepfathers and stepmothers, their mothers and fathers, half-brothers and sisters, people who raised the child, guardians, caregivers and even common-law husbands will be able to see and communicate with the child without permission from the parents. legal parent.
