Social accounts with alimony and benefits will be unavailable for bailiffs

Russians will be able to create separate social bank accounts. Benefits and alimony, pensions and compensations will be credited to them, and bailiffs will not be able to foreclose.

Such a bill passes the second reading in the State Duma of Russia. In the first reading, the law was passed two years ago.

The current law "On Enforcement Proceedings" prohibits bailiffs to seek compensation, lump-sum social benefits, child benefits, maternity capital, alimony.

But everywhere there are cases when bailiffs impose arrest and in fact illegally write off the debtor's money, without knowing whether they are inviolable or not.

Of course, illegally written off sums are returned back, but for this, the debtor has to go to the bailiffs, write a statement, provide the executors with a certificate stating that he receives, for example, child allowance to the specified account, and then wait for quite a while for the bailiff to cancel the arrest and return back written off funds. Also, the issue can be resolved through the court, which does not reduce the time costs at all.

The new law, which is now being considered by parliamentarians, directly prohibits banks to execute the decision of the bailiff to arrest a special social accountif it receives benefits, alimony or other social benefits.

At the same time, the owner of such an account will not be able to hide on it their own money, which is not related to child benefits or alimony payments. This means that the debt will have to be paid in any case, but nobody will even try to write off the funds protected by law.
