Russia plans to cancel automatic recognition of the former spouse’s child’s dad
In Russia, thinking about the abolition of the law, which automatically recognized as the father of the child's ex-husbandif the couple broke up while the wife was pregnant or officially divorced was not registered. If the new mother declares that her ex-husband has nothing to do with the child, the name of the former will not be entered into the birth certificate, even if 300 days after the divorce before the birth has not yet passed.
The State Duma of Russia received such a proposal and they are going to consider it very soon.
Today, according to the current legislation, children born to a man and a woman who officially registered the marriage are automatically indicated in the certificate by the spouse of the woman. This is also the case if a couple breaks up during the pregnancy of the wife, before her, but does not formalize the dissolution of the marriage.
Quite often, the current state of affairs leads to misunderstandings and lawsuits: a spouse is recorded as a father, even if the woman convinces the registrars in the registry office that she has given birth to a completely different man's child. We have to go to court to exclude the entry and add the name of the real father to the document.
Therefore, deputies propose to abolish automatic paternity. If a woman says that the husband is not the father of the child, you do not need to enter it. But in this case, the present father of the baby will need a separate statement to the registry office with a request to enter it in the birth document of the child.
