For the abduction of a child by the second parent in Russia may introduce criminal liability

The system of fines and criminal liability is planned to be introduced in Russia for the abduction of a child by one of the parents. With such a proposal to the Government of Russia came the chairman of the National Parental Committee Irina Volynets. The head of the Cabinet of Ministers, Dmitry Medvedev, received a letter from her and submitted the initiative to the State Duma of Russia for discussion and consideration.

Irina Volynets noted that after parting or divorce it often happens that one of the parents takes the child and retains the baby for no reasonwithout giving the second parent the right of meeting or address. At the same time, the deprived parent has all legal rights - by decision of the court, the child’s place of residence is determined with him.

In the overwhelming majority of cases, the fathers do this, and the mothers are then forced to upholster the thresholds of law enforcement agencies, bailiffs and courts, in order to defend their legitimate right to raise a baby.

The government was asked to equate such cases with a kidnapping. And the punishment for abduction must be appropriate - strict and criminal.

At the first such abduction is proposed to impose a fine on the guilty parents in the amount of 50 thousand rubles. If he decides to be re-abducted, his actions will already be qualified in accordance with Article 126 of the Criminal Code of the Russian Federation “Abduction of a Person”. According to her for the perpetrator provides long prison term - up to 12 years in prison.

The new initiative, however, supports the rights of the second parent to meet and communicate with the child after the divorce. If a mother, for example, does not allow her father to communicate with her child after the divorce, she will have to pay a fine of 1 to 5 thousand rubles, provided that the pope will complain to the former spouse to the law enforcement authorities.

Deputies of the State Duma have already begun a preliminary discussion of this initiative. And while the majority of parliamentarians are prone to the fact that Article 126 of the Criminal Code is too harsh a punishment, but there must be a response. What they should be, people's deputies will be determined during the meetings of relevant committees, after which work should begin on the creation of a relevant bill.
