In Russia, may prohibit paid surrogacy

To prohibit payment for the services of a surrogate mother was proposed by State Duma deputy Vitaly Milonov. He prepared a bill on the prohibition of commercial surrogacy in the country. It notes that this service is not regulated by the state and can be equated to the sale of children.

Today in Russia, surrogacy is not regulated by law, and the existing agreement is not a paid type agreement.

Therefore, a clear framework should be established in which surrogate mothers services will take place, but women will not be able to charge for their services. In other words, such a form of assisted reproductive technology should become voluntary, and either a relative or a close friend interested in helping, not in making money, will be able to endure for a sterile couple.

The bill also provides ban on advertising surrogacy servicesas contrary to ethics and public morality. In addition, the document implies a clear definition of the legal status of the parties to the contract.

If the law is passed, then “customers” (biological parents) will pay surrogate mother's running costs only - on examinations, on food, on vitamins, on childbirth. Other forms of remuneration will be prohibited by law and will be prosecuted.

Strong social requirements will be established for potential parents, which will be spelled out in the Family Code.

It is proposed to prohibit the use of surrogate mothers services to single men (as Philip Kirkorov did), can resort to such services only couples or single women.

Violations are proposed to be punished according to the existing regulatory framework: the child will be withdrawn by the state, and the parties will bear criminal and administrative responsibility for trafficking in persons.
