Consent of the parents to the trip of the child in Russia and abroad

Content

Long ago there were times when a child without parents went to rest only to the grandmother in the village or in the nearest country camp. Now our children quite a lot and willingly travel both in Russia and abroad. And this is not only ordinary recreation, but also collective excursions, participation in international and national championships and creative competitions, training in other regions and abroad.

In order for the scheduled tour to take place, the parents and the official representatives of the child need to know exactly what documents will need to be issued for routes throughout the country and abroad. In this article we will talk about parental consent for the trip.

Kinds

The consent of the mother and father to the child’s journey is a document that is obligatory and necessary in almost all cases while the child is a minor. For trips within the country, such paper is rather a formality, a kind of safety net for teachers or coaches who send and accompany your children to the destination and back. But for crossing the state borders of Russia, consent from parents for a trip abroad is mandatory. If you have to travel to a country belonging to the Schengen zone, consent will be required at the stage of obtaining visas.

Parents can express their consent in different ways. For traveling around the country accompanied by relatives (grandmother, grandfather, sister or brother), a written permission notarized is sufficient.

The power of attorney, necessarily notarial, is issued for a trip abroad or for traveling in his native country, but accompanied by an adult person who is not a blood relative.

The power of attorney can be direct (when one of the parents trusts the other to accompany the baby on the journey) and cross (when the parents mutually trust each other to travel with the child to this or that country).

Do I need consent for a trip to Russia

The answer to this question sounds ambiguous - agreement is necessary, but not necessary. Police officers, traffic police, representatives of the Federal Migration Service, employees of the airline, Russian Railways have the right to ask at any time what reason the child travels without parents, who and why he is accompanied, and whether this adult has permission from the parents.

The document mom and dad (or one of them) must be in accordance with the established sample or in free form, but be sure to notarize the paper. This concerns permission. If the decision is made to make a power of attorney for the attendant, then the notary will do it with the mandatory personal presence of both the parent and the person whom he trusts his child.

If the mother and father are divorced, the compulsory consent of the second spouse is not required for the child to travel within the country.

Consent to travel in Russia, as already mentioned, in most cases is formal, rarely checked. But to have such paper is desirable, as they say, just in case. It can be useful in such cases:

  • If the child goes to another region for an excursion with a teacher;
  • On competitions accompanied by a coach or teacher;
  • If you plan a children's holiday in a federal camp, such as "Artek";
  • If the child is studying in another area, and on holidays he goes by train or bus home and back.

When traveling around the country, a child needs to carry a birth certificate, and if he is already 14 years old, then a passport. The accompanying person will need a passport and power of attorney from the parents (or permission).

Trip abroad

When traveling abroad without mom and dad, consent from the parents is obligatory. Without it, the child will not be released outside of Russia. When he goes with one of his parents, a notarized power of attorney from the second is necessary, even if they have been divorced long ago. If children move with an adult who is not a relative (teacher, coach, guide), a power of attorney from both parents is required. A grandmother must also have a notarial document if she travels with her grandchildren.

If a voyage is planned to the countries of the Schengen agreement, the power of attorney will need to be issued in double quantity. One will remain at the embassy upon receipt of the visa, the other should be with the accompanying person. I will say at once that taking a photocopy will not work, since a copy of such a document is invalid.

Sending a child abroad, you can do without drawing up the notarial consent only in some cases. When the second parent has died and there is a death certificate, when the second parent is in custody, the colony certificate will suffice. If the father or mother is deprived of parental rights, it is enough to take a court decision about it. And when one of the parents does not get in touch or goes missing, the second will be enough to get a certificate from the police station where they live.

On an overseas trip for a child, take along your passport, visa, travel documents, birth certificate and medical insurance. The accompanying person will need his passport, like a Russian, as well as a foreign, visa, consent from parents. It is advisable to translate the power of attorney into English and reassure again.

Required documents

To make a permit or power of attorney, you need to contact a notary. The application for consent is signed personally by both parents and the one who will be the maintainer. Now often as an accompaniment indicate the name of the organization, a representative of which will go along with the children.

In any case, travel companies that organize collective children's excursions act this way, motivating by the fact that it is difficult to predict in advance exactly which employee will travel with the group. However, it is better to insist on the instructions of several specialists, so that later, if something happens, there is someone to ask by law.

You must take Russian passports with you to the notary, the birth certificate of the child (or children), if the child has already turned 14, take his passport. Spouses will need a marriage certificate, divorced - a document about the dissolution of marriage.

If the baby and his parents have different surnames, prepare the originals of all the necessary documents that could confirm your relationship and the reasons for changing the names (certificate of divorce, marriage, certificates from the passport service if there was an arbitrary change of name).

Be prepared to answer a few notary questions to the notary. He will surely ask and indicate in the power of attorney what period of time is planned for the trip, to which country or several countries is allowed to leave.

The power of attorney will be printed on a special form, certified by the signatures of the parents and the signature and personal seal of the notary.

Validity

Parental permission to travel in Russia is usually issued for a period of 3 years. But you can write in the document and a shorter period. A power of attorney from parents when leaving a child abroad is more often issued for a period of three months.

This does not mean that it is impossible to issue a consent for a longer time. It is possible, but not a fact, that border officers of the meeting state will accept such power of attorney.In order not to be trapped, it is necessary to consult in advance (on the Internet or by phone) with representatives of the embassy of the chosen country about the validity of the parental power of attorney.

For some countries, for example, in the Schengen zone, this question is more than a matter of principle, and in the overwhelming majority they require a separate consent for each entry. To travel to Turkey or Egypt, a power of attorney is sufficient, which is drawn up for a period of 1 to 3 years.

How old is power of attorney?

A power of attorney or permission from the parents to travel is required for any child who is legally considered a minor, that is, he has not yet turned 18 years old.

How to make a power of attorney or consent?

To form an agreement for a trip to his native country, as we have already found out, it is possible to do it yourself. The main thing, then do not forget to notarize the document at the notary. It must contain the detailed passport details of the parents, the details of the child, the passport details of the accompanying person, the regions that are allowed to visit, the estimated dates of travel. Do not forget to specify the date of the paper and the city in which it occurs.

It is desirable that the document indicated the purpose of the trip and briefly outlined the powers of the person accompanying it. It is not difficult to find a sample of the authorization on the Internet.

A notarized power of attorney for a trip abroad is drawn up according to a single sample, which is available to any notary. First, the parents will fill out applications on the form that they will be given, and then the notary will enter all the data indicated by them after checking the original documents on the consent form. This document will also include passport details of the parents accompanying them, the birth certificate of the child if he does not have his passport, the passport of the child, the country, the dates and the purpose of the trip.
